Data Privacy Policy
This policy applies to all personal data processing carried out by Flux IT.

2. DATA PROCESSING IDENTIFICATION – DATA COLLECTION
In compliance with current regulations on the protection of personal data, the Argentine Personal Data Protection Act 25.326, its Regulatory Decree N° 1558/01, and its complementary regulations (“Argentine PDPA”), Flux IT collects personal data when users:
– Complete the form on www.fluxitsoft.com (“website”).
– Subscribe to the newsletter.
– Respond to a survey or complete a web form.
– Send an e-mail or communicate by phone, and such information is subsequently used to complete the corresponding forms.
3. COLLECTED DATA TYPES
Flux IT collects information from visits to its website, especially when completing registration forms, thus collecting the following data:
– Full name.
– E-mail address.
– Company name.
In general, when personal data is requested to use a service or to access certain content, its provision will not be mandatory, except on occasions in which it is specifically indicated that such information is required for service provision, in which case users may freely choose not to register and/or not hire the service.
Users declare and guarantee that all data provided by them is true and correct and they agree to keep such data updated. Furthermore, users acknowledge that data required by Flux IT is necessary, adequate, and not excessive for the purposes stated in section 4 of this document, which would be impossible to comply with if such data was not provided.
Users will be responsible for any false or inaccurate statements that arise as a result of the information and data provided, as well as for the damages that such information could cause.
4. PURPOSES OF USING THE COLLECTED DATA
The personal data required from users will have the following purposes:
- In the event of hiring services offered through the site, data will be used to create and maintain business relationships and to carry out activities and provide Flux IT’s services (including, but not limited to, service management, administration, provision, and improvement).
- To send Flux IT’s newsletters, as well as commercial correspondence, offers, and/or advertisements, either occasionally or periodically. In this regard, the e-mail address provided by users when completing the web form may be used to send information and updates about service requirements, as well as news about Flux IT (either occasionally or periodically), updates, information about related products or services, among others. This processing is based on our legitimate interest in promoting our products and services.
- To customize user experience, thus increasing our ability to respond to users’ needs and to improve the site and Flux IT’s service offering, based on our legitimate interest in improvement.
- To process transactions and comply with the legal obligations to which Flux IT is subjected, such as tax obligations.
Data that is subjected to processing will not be used for purposes other than those mentioned and that have motivated data collection. Notwithstanding the above, it is noted that the registered data may be used, in addition to the purposes for which it has been expressly collected, to conduct statistical analysis, manage incidents, or conduct market surveys.
However, if personal data is processed for a purpose other than one of those initially specified when collecting such data, Flux IT will conduct a compatibility analysis in accordance with applicable regulations. Processing will only be authorized if the original purpose is compatible with the new purpose or permitted in accordance with an independent legal basis. In such cases, users will be informed of the change of purpose or will receive a legal justification for their data’s processing.
Users may object to receiving commercial correspondence (unsubscribe) and stop receiving e-mails from Flux IT by appropriately notifying the company which will proceed to discontinue such communications as soon as such notification is received. For this purpose, users may send an e-mail or postal mail to the addresses indicated in section 1 or they may simply follow the instructions to unsubscribe which are provided at the end of each Flux IT e-mail.
By providing personal data to Flux IT, users declare their full and unconditional acceptance of the processing of such data by Flux IT. In addition, users hereby grant their free, explicit, and informed consent for Flux IT to use the data collected for the purposes indicated in section 4 of this policy, as well as their inclusion in Flux IT’s database.
Flux IT processes users’ authenticated data for:
- The hiring of Flux IT’s services by users, which happens in accordance with the terms and conditions made available to them when completing a potential contract.
- Users’ free, informed, and unequivocal consent, given after reviewing this privacy policy in which Flux IT informs them of their data processing. If it occurs that such data processing is not covered by any of the aforementioned legal bases, it will be carried out by Flux IT if the company considers it necessary to safeguard a legitimate interest and only in cases where it does not contravene the user’s fundamental rights and freedom.
6. EXPIRATION – DATA RETENTION TIME
Data will be destroyed or stored when it is no longer strictly necessary or relevant to the purposes detailed in section 4. In particular, personal data will be kept for as long as the commercial relationship is in force (and as long as the user has not previously requested its deletion), and for the period during which obligations, indemnities, and/or responsibilities arising from the business relationship or services provided may arise.
Flux IT informs that it will retain the essential information to identify the origin of the data stored for the duration of the customer’s relationship with Flux IT and/or the revocation of the user’s consent in accordance with the information provided in section 4 of this privacy policy and/or the time required by applicable law.
Flux IT will keep the personal data collected as confidential and under reserve and will not use it for purposes other than those established in section 4 of this policy.
Flux IT requires the signing of confidentiality and personal data processing agreements by its employees and third parties that provide services and access the database’s content.
Personal data collected by Flux IT will not be granted, sold, exchanged, transmitted, and/or communicated to third parties external to Flux IT without the user’s consent, except for legal obligations and/or for the purpose of providing services to users. This does not include certain employees and supplier companies that allow Flux IT to keep the site operational, fulfill the purposes established in section 4 of this policy, or provide services to users; companies that have assumed the obligation to maintain the confidentiality of the data provided and that are committed to complying with applicable data protection regulations at the time of their hiring.
Contracts with supplier companies specify the object, scope, content, duration, nature, and purpose of data processing, the type of personal data, the categories of data subjects, and the obligations and responsibilities of Flux IT and hired third parties.
In particular, Flux IT may share the provided personal information with affiliated companies and/or intermediary individuals related to Flux IT.
Flux IT may share personal information provided by the user internally with certain departments, such as Administration, Marketing, or Infrastructure. In certain cases, Flux IT transfers personal data based on the legitimate interest and the economic and technical advantages associated with the use of specialized suppliers.

Flux IT also uses social media, such as Facebook, Instagram, Twitter, or LinkedIn, and has integrated functions from these networks into its services. Users can only use these social networks to the extent that they have created an account and have logged in on the corresponding social network. These social networks have their own privacy policies and terms and conditions, over which Flux IT has no control or influence.
Finally, users should be aware that Flux IT may (and reserves the right to) disclose their information in the following cases:
– If requested by a judicial or administrative authority.
– If necessary to exercise their rights under Flux IT’s terms and conditions and this privacy policy.
– If such data could be useful for the protection of the rights of third parties.
– When useful for the protection of the rights, property, or safety of Flux IT, its parent companies, affiliates, board of directors, managers, employees, users, or the general public.
– When there are well-founded reasons related to public safety, national defense, or public health.
Flux IT states its intention to adopt the technical and organizational measures necessary to guarantee the security, integrity, and confidentiality of data in accordance with the Argentine PDPA, in order to prevent its modification, loss, unauthorized access, or processing.
Flux IT does not guarantee absolute privacy in the use of the site since it cannot be ruled out that unauthorized third parties may have access to it. Users acknowledge that the existing technical means that provide security are not impregnable, and that, even if all reasonable security measures are taken, it is possible to suffer manipulation, destruction, and/or loss of information.
In the event of a security breach being detected and which involves a significant risk to the data subject, Flux IT will notify the competent supervisory authority without delay, along with the corrective measures implemented and/or to be implemented.
Flux IT is not responsible for the loss or deletion of data in the hands of users. Furthermore, Flux IT accepts no responsibility for any possible damage caused by computer viruses.
Finally, users must also take measures to protect their information while on the internet. At a minimum, it is advisable that users change their password periodically, using a combination of letters and numbers, and that they ensure that they are using a secure browser.
9. RIGHTS OF DATA SUBJECTS
Users, as data subjects, may exercise their rights of access, rectification, cancellation, opposition, and restriction of the processing, portability, confidentiality, and deletion of their personal data at any time, in accordance with the provisions of the Argentine PDPA, as applicable.
The exercise of these rights can be carried out by users themselves through an e-mail addressed to info@fluxitsoft.com or by any of the methods provided for in the applicable regulations indicated in section 1. Flux IT may request the necessary information to validate the data subject’s identification. The deletion of some data will not proceed if it could cause harm to the rights or legitimate interests of third parties or if there is a legal obligation to retain such data.
The site may contain links to third-party sites, with or without advertising content, and their privacy policies are alien to Flux IT. Linked sites have no relationship with Flux IT, and their existence does not in any way imply any kind of suggestion, invitation, or recommendation to visit the destination sites or any kind of link or association between Flux IT and such sites.
Flux IT is not responsible for, and will not respond to, the content, use, and activities of these linked websites, nor to any damages, whether actual or potential, material or moral, direct or indirect, suffered by users resulting from the information contained on such sites or from the relationship that users may establish with third parties whose services have been published on the site. Notwithstanding the above, any comments on these linked websites will be useful for Flux IT to improve its services and/or ensure the integrity of the site.
Flux IT undertakes to do its best to prevent the existence of links to sites with illegal content.
11. USE OF COOKIES
When users enter the site, Flux IT may store some information on their computer as “cookies” or as a similar file. The site uses cookies in order to:
– Track advertising.
– Collect data about site traffic.
– Improve user experience when using the site.
Users should be aware that it is not necessary to allow the installation of cookies sent by the site to browse it. Users can delete cookies from their computer’s hard drive and prevent access to their computer through their browser. Cookies are text files that a website transfers to the user’s computer’s hard drive through the browser. Even though cookies themselves cannot personally identify a user (they can actually identify the user’s IP address), they allow IP addresses to recognize the browser and capture and store certain data (user’s operating system, domain name of the website from which they linked to the site, among others).
Flux IT reserves the right to hire third-party services to analyze and understand the site’s users and such companies cannot use the information collected for purposes other than improving Flux IT’s services.
12. USER ACCEPTANCE
The fact that users make use of the site implies their knowledge and full acceptance of Flux IT’s data privacy policy. Likewise, users accept Flux IT’s privacy policy and its terms and conditions in a commercial agreement, either as a customer or as a supplier company.
This is the current version of the privacy policy, updated as of September 2023.
Flux IT may, at any time and without prior notice, modify this privacy policy. Such modifications will be effective upon publication on the site or as early as users are notified by any means, whichever occurs first. Users should periodically check the terms included herein by accessing them regularly.
